Estate Planning

An estate plan is a set of legal documents to prepare for your incapacity and death. It typically includes a will, a durable power of attorney, an advance directive, and may include a revocable trust and other ancillary documents. After collecting some information from you, we can discuss which documents you would like at your initial consultation. We prepare estate plans for Oregon and California residents and soon will be licensed in Washington.

Taxes

Estate tax returns are required by Oregon, Washington, and the federal government if you die with an estate valued at over the applicable exemption. Gift tax returns are required for liftetime gifts over the federal annual exclusion amount. We prepare estate tax returns and gift tax returns and assist with planning for both.

Probate

Probate is the court-supervised process of administering estates with assets that do not pass by beneficiary designation, joint ownership, or terms of a trust. It includes wrapping up the deceased person’s affairs and distributing the estate assets. We advise clients in administering probate estates in Oregon and California.

Protective Proceedings

Protective proceedings are court supervised matters where a fiduciary is responsible for managing the affairs of an incapacitated person. We represent clients in guardianships over persons who lack capacity to manage their health and/or living situation and conservatorships over persons who lack capacity to manage their finances in Oregon.

Trust Administration

When a person with a revocable trust becomes incapacitated or dies, we represent their successor trustee in administering their trust.

Prenuptial Agreements

We represent one member of a couple in negotiating and preparing agreements prior to a marriage or domestic partnership in Oregon and California.
